Terms of Service

These Terms of Service ("Terms") are a legal agreement between you ("you" or "User") and Cosmic Jellyfish, LLC ("Company," "we," "us," or "our"), governing your use of the Nakshatra web and mobile applications and related services (collectively, the "Service"). By using the Service, you agree to be bound by these Terms.

1. The Service

Nakshatra offers free calculated birth-star discovery and editorial reflections, with personal AI-assisted chart readings, life chapters, and an optional Monday letter by email for paying members.

2. Disclaimer — For Informational & Cultural Purposes Only

All calendar content, readings, insights, and interpretations provided through the Service are for informational and cultural purposes only. They do not constitute professional advice of any kind, including but not limited to medical, financial, legal, psychological, or relationship advice.

You acknowledge that astrological and ritual interpretations are subjective. The Company makes no representations or warranties regarding the accuracy, completeness, reliability, or applicability of any content. You should not make important life decisions based solely on content provided through the Service.

3. Eligibility & Accounts

You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction). You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

4. Subscriptions & Payments

The Service offers free features and a premium subscription ("Nakshatra Premium"). Web subscriptions are processed through Stripe; iOS subscriptions are processed through Apple's App Store and subject to Apple's terms.

• Payment is charged at confirmation of purchase.
• Membership includes up to 16 new readings per rolling 30 days and up to 3 per rolling 24 hours. Opening a saved reading does not use this allowance. A temporary service-wide limit may delay generation.
• Subscriptions automatically renew unless canceled before the end of the current billing period.
• Web subscribers can manage or cancel through the in-app billing portal; iOS subscribers through Apple ID settings.
• Refunds are handled by the original payment provider.

We reserve the right to change subscription pricing. Price changes take effect at the start of your next billing period following notice.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful, fraudulent, or harmful purpose.
• Share another person's birth data without their explicit consent.
• Reverse-engineer, decompile, or extract source code from the Service.
• Use automated tools, bots, scrapers, or crawlers without authorization.
• Misrepresent your identity or harass other users.
• Commercially redistribute readings or other Service content without our prior written consent.

6. Intellectual Property

The Service and its contents — software, design, text, graphics, logos, icons, and algorithms — are owned by Cosmic Jellyfish, LLC and protected by copyright, trademark, and other intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes.

7. Privacy

Your use of the Service is also governed by our Privacy Policy.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).

10. Indemnification

You agree to indemnify, defend, and hold harmless Cosmic Jellyfish, LLC from any claims arising out of your use of the Service, your violation of these Terms, or your violation of the rights of any third party.

11. Dispute Resolution & Arbitration

PLEASE READ THIS SECTION CAREFULLY — IT AFFECTS YOUR LEGAL RIGHTS.

You and Cosmic Jellyfish, LLC agree to resolve any disputes through final and binding individual arbitration under the rules of the American Arbitration Association.

Class Action Waiver: Disputes shall be resolved on an individual basis only, and you waive any right to participate in a class action or representative proceeding.

Opt-Out: You may opt out of this arbitration provision within 30 days of first accepting these Terms by emailing support@getnakshatra.com.

12. Termination

We may suspend or terminate your access at any time if we believe you have violated these Terms. You may terminate your account at any time by emailing support@getnakshatra.com.

13. Modifications to the Service

We reserve the right to modify, suspend, or discontinue the Service at any time, with or without notice.

14. Changes to These Terms

We may revise these Terms from time to time. Material changes will be notified through the Service. Continued use after the revised Terms take effect constitutes acceptance.

15. General Provisions

• Governing Law — Delaware, without regard to conflict-of-law principles.
• Entire Agreement — These Terms and the Privacy Policy constitute the entire agreement.
• Severability — Unenforceable provisions shall be limited; the remainder remains in force.
• Waiver — Failure to enforce any provision is not a waiver.
• Assignment — You may not assign your rights without our consent.
• Force Majeure — We are not liable for circumstances beyond our reasonable control.
• Electronic Communications — You consent to receiving electronic communications from us.
